Misdemeanors

Florida law classifies misdemeanors into two degrees based on their severity: first degree and second degree:

First Degree Misdemeanors

Are considered more serious and can result in harsher penalties. They can include up to one year in jail, a fine of up to $1,000, probation, community service, or both. Examples of first-degree misdemeanors include battery, cruelty to animals, DUI, domestic violence, indecent exposure, marijuana possession, prostitution, shoplifting, and vandalism.

Second Degree Misdemeanors

Are less serious offenses and can include up to 60 days in jail, a fine of up to $500, probation, or both. Examples of second-degree misdemeanors include driving with a suspended license, disorderly intoxication, first offense petit theft, loitering, and some trespassing charges
